Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to My Nutrition Balance.

Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.

Service refers to the Website.

Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service. This Terms and Conditions agreement has been created with the help of the Free Terms and Conditions Generator.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

Website refers to My Nutrition Balance, accessible from https://mynutritionbalance.com

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Please read these terms and conditions carefully before using Our Service.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between you and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Signing the Terms and Conditions confirm your consent for nutrition services delivered by My Nutrition Balance.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms and Conditions then you may not access the Service.

You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service. Clients under the age of 18 must have parental or guardian consent to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You.   • The purpose of My Nutrition Balance is to provide you with support, information and dietetic advice to help you improve your health and wellbeing based on scientific evidence.
  • My Nutrition Balance provides nutritional guidance but does not provide medical advice, diagnosis, or treatment. All health-related concerns should be addressed by a licensed doctor.

Appointments

The contract begins with the acceptance of your booking and the completion of the Terms and Conditions and Privacy Policy forms.

The initial consultation will be agreed between the dietitian and the client and you will receive an e-mail confirming this. You will also receive a notification in your device 5 minutes before the consultation. The assessment will be undertaken and a treatment plan agreed. The need for further treatment will be communicated and agreed upon. A written report will be generated, if agreed, and shared with any parties needed (e.g. GP or consultant) with your prior consent. You can book self-pay services of My Nutrition Balance, which can be covered by Private Health Insurance, by contacting us directly or your treating doctor can refer you to us.

Review appointments will be agreed in advance and confirmed via e-mail. If you book a block of sessions, these can be taken over any reasonable time period as agreed between the dietitian and the client. Future sessions will be booked at the end of the session. A report or action points (as appropriate) will be generated and sent to the client and any other parties as required and with prior consent from the client.

When the virtual consultation starts, the dietitian will be waiting in the room for 15 minutes before ending the call if there is no show up. This will be classified as Did Not Attend (DNA). At 5 minutes post the consultation time, the dietitian will send a message on the virtual platform to notify you of the appointment.

All packages must be used within the timescales specified on our Website: www.mynutritionbalance.com/packages.

  • If you do not book and complete your sessions within the specified period, the package will expire, and you will no longer be able to book further sessions.
  • No refunds will be provided for expired or unused sessions.
  • Extensions may be granted at our sole discretion in exceptional circumstances, such as medical emergencies (supporting documentation may be required).

Medical Concerns

If, during, before or after the consultation, it becomes evident that there are concerning changes in your health or medical condition that require attention, I reserve the right to notify your GP or healthcare provider in your best interest. This will be done with your prior consent unless it is a medical emergency. By agreeing to these Terms, you consent to My Nutrition Balance sharing your dietary reports and treatment plans with your healthcare provider, where necessary.

Cancellation

Please note the full consultation fee will be charged for non-attendance or cancellation within 24 hours, unless there are extenuating circumstances assessed by the dietitian. Rescheduling can only be done if paying separately for another appointment. If you cancel your appointment within 2 working days, you will be charged 50% of the fee and rescheduling will be subject to availability. If you arrive more than 15 minutes late, your session will be classified as Did Not Attend (DNA), and no refund will be issued. Private health insurance companies will not make payments for cancelled appointments, and you will be charged for these costs personally. You can cancel your contract with My Nutrition Balance at any time.

Fees

  • Fees will be agreed upon before booking appointments. We reserve the right to change prices.
  • Pre-payment is required for online bookings. In some circumstances, instalments may be accepted.
  • Invoices must be settled within 5 working days unless otherwise agreed in writing. Late payments will be subject to:
    • A £15 administrative fee for overdue invoices.
    • Referral to a debt collection agency if unpaid after 30 days. The client will be responsible for all recovery costs.
    • We will not use any agency that will process debts with interests. Please let us know immediately if interests is included.
  • If you have private health insurance then, the services of My Nutrition Balance will be invoiced directly to your health insurance company. An authorisation code from your health insurance provider must be provided before commencing treatment.
  • The following process will apply in the event of non-payment:
  • The Dietitian will contact the client to remind them that that payment is overdue.
  • If an invoice is not paid within 7 days thereafter, the client will receive written notice that therapy is suspended pending payment in full.
  • If payment is not received in full within 7 days of therapy being suspended, the dietitian reserves the right to refer the matter to a solicitor and to commence legal action.
  • My Nutrition Balance may terminate the contract due to important reasons, such as due to incorrect information, My Nutrition Balance may retain all payments already received.

Under the UK Consumer Rights Act 2015 and Digital Markets, Competition and Consumers Bill 2025, you have certain rights regarding digital services.

  • If a service is not as described, you may be entitled to a repair or replacement session.
  • Refunds are only provided where required by law and are not granted for change of mind, unused services, late arrival or failure to book within the package timescale.

Data protection

The dietitian is registered with the Information Commissioner's Office (ICO) as a Data Controller, registration number ZB652675.

All client details, case notes and correspondence will be stored securely and treated confidentially according to General Data Protection Regulations and the Data Protection Act 1988.

Information is stored in accordance with HCPC and BDA standards.

6. Electronic Communication

E-mail is the preferred method of communication but is never 100% secure, with your consent we will send all communication via the e-mail address you provide us with.

Copyright

  • Materials of My Nutrition Balance (e.g. Patient information, worksheets, leaflets etc.) are the property of My Nutrition Balance or have been licensed and are protected in whole or in part by copyright. They may be passed on to third parties only with the written consent of My Nutrition Balance.

My Nutrition Balance is committed to protecting your personal data under the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.

  • Your data will only be retained for as long as necessary for service delivery and regulatory compliance.
  • You have the right to access, rectify, delete, or restrict processing of your data.
  • Data will never be sold or shared with third parties for marketing purposes without explicit consent.

Our Service may contain links to third-party websites or services that are not owned or controlled by My Nutrition Balance.

My Nutrition Balance has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that My Nutrition Balance shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

Upon termination, your right to use the Service will cease immediately.

Where our Website contains links to other blogs and resources provided by users, these links are provided for your information only. Mu Nutrition Balance has no control over the contents of those sites or resources.

Limitation of Liability

My Nutrition Balance shall not be held liable for any medical complications or conditions arising from the misuse of dietary advice without providing full medical and family history. It is the client's responsibility to ensure that any dietary changes or supplements are discussed with their healthcare provider appropriately. Please consult with a doctor for any health issues, concerns or circumstances. Do not delay or disregard medical advice based on information from My Nutrition Balance. My Nutrition Balance is not responsible either directly or indirectly for damage, health problems or inconvenience caused by the use or misuse of the information provided by My Nutrition Balance. You are responsible for any consequences resulting from misstatements.

To the maximum extent permitted by applicable law, in no event shall My Nutrition Balance or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the My Nutrition Balance, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the My Nutrition Balance or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some countries do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these countries, each party's liability will be limited to the greatest extent permitted by law.

Our platform may use automated decision-making or artificial intelligence (AI) to provide personalised nutrition recommendations. These are based on data you provide and do not constitute medical advice. You should always consult a healthcare professional before making significant dietary changes.

Viruses

My Nutrition Balance will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any Website linked to it.

My Nutrition Balance assumes no responsibility for the content of Websites linked on the Site. Such links should not be interpreted as endorsement by us of those linked Websites. My Nutrition Balance will not be liable for any loss or damage that may arise from your use of them.

My Nutrition Balance does not guarantee that the Website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our Website. You should use your own virus protection software.

You must not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material, which is malicious or technologically harmful. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

We are not liable for delays or failure to provide services due to events beyond our control ("Force Majeure"), including but not limited to:

  • IT system failures, cyberattacks, or third-party service interruptions.
  • Strikes, labour disputes, or supply chain disruptions.
    If affected, we will take reasonable steps to resume services as soon as possible

If you have any concern or dispute about the service, you agree to first try to resolve the dispute informally by contacting Nutrition Balance.

For European Union (EU) Users

If you are a European Union client, you will benefit from any mandatory provisions of the law of the country in which you are resident.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if we have made them available to you on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. For every revision, we will let you know through email with a summary of key updates to ensure transparency. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Website and the Service.
